Toxic Mold

Miller Injury Attorneys and trial attorney John C. Miller Jr. obtained a $14,950,200 jury verdict following a Sacramento County jury trial on behalf of 43 tenants living in allegedly dangerous and uninhabitable conditions. Approximately $14.94 million—roughly 99.9% of the verdict—consisted of noneconomic damages, including mental suffering, anxiety, humiliation, inconvenience, emotional distress and loss of enjoyment of life. Only approximately $13,600 represented property damages.
The jury found defendants liable for negligence, breach of the implied warranty of habitability, nuisance and fraud/concealment.
2001 — $2.721 Million Toxic Mold Personal-Injury Verdict
In 2001, just as toxic-mold litigation was emerging as a new area of law, Miller obtained a $2.7 million Sacramento jury verdict that was reported at the time as the largest toxic-mold personal-injury verdict in United States history. Contemporary publications, including the Insurance Journal, reported the Mazza verdict as the largest toxic-mold personal-injury verdict in the United States at the time. Other prominent publications reporting on the case included Los Angeles Times, Sacramento News & Review, California Bar Journal, and the Sacramento Business Journal.
